These Terms & Conditions ("Terms") govern your access to and use of the Rizz Up website, rizzup.store, and your purchase of products from Rizz Up Private Limited.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

If you do not agree with these Terms, please do not use the website or place an order.

Rizz Up is an online clothing brand currently offering products for delivery within India.

ELIGIBILITY TO USE THE WEBSITE

You may use the Rizz Up website and purchase products if you are legally capable of entering into a binding transaction under applicable law.

If you are under 18 years of age, you should use the website and place orders only with the involvement and permission of your parent or legal guardian.

By placing an order, you represent that:

The information you provide is accurate;
You have the necessary authority to place the order;
You are legally capable of entering into the transaction; and
Where applicable, you have obtained the consent of your parent or legal guardian.

CUSTOMER ACCOUNTS

Customers may be required to create an account to complete purchases on the Rizz Up website.

Rizz Up may suspend or terminate an account where there is reasonable evidence of fraud, abuse, unlawful activity or material violation of these Terms, subject to applicable law.

You may use rizzup.store only for lawful purposes and in accordance with these Terms.

You must not use the website to:

Violate any applicable law;
Commit fraud;
Attempt unauthorised access;
Interfere with website security;
Introduce viruses, malware or harmful code;
Scrape or systematically copy website content for commercial purposes without permission;
Impersonate Rizz Up or another person;
Attempt to disrupt website operations;
Abuse promotional offers;
Manipulate reviews;
Submit fraudulent claims; or
Engage in any activity that could harm Rizz Up, its customers or its systems.

PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements and other product information displayed on our website are accurate.

However:

Colours may appear differently depending on your device or display;
Minor variations may occur due to manufacturing and printing processes;
Product photographs may contain styling or presentation elements that are not included with the product; and
Measurements may have reasonable manufacturing tolerances.

Rizz Up reserves the right to modify product designs, specifications, colours, sizes, availability, descriptions, photographs and other product information.

Such changes will not affect an order that Rizz Up has already accepted, except where correction or cancellation is required due to an obvious error, legal requirement or circumstances beyond reasonable control.

PRODUCT AVAILABILITY

All products are subject to availability.

A product appearing on the website does not necessarily guarantee that it will remain available until an order is completed.

If a product becomes unavailable after an order is placed, Rizz Up may contact the customer regarding an appropriate resolution, which may include cancellation and refund of the unavailable product.

PRICES

Product prices displayed on the website are the prices applicable at the time of purchase, subject to applicable taxes and other charges disclosed during checkout.

Shipping charges and applicable COD charges will be displayed separately where applicable.

Rizz Up reserves the right to change prices at any time before an order is accepted.

Pricing or system errors

If an obvious pricing or technical error causes a product to be displayed at an incorrect price, Rizz Up may take reasonable steps to correct the error.

Where an order has been placed based on an obvious pricing error and the order has not been accepted/fulfilled, Rizz Up may cancel the affected order and refund any amount already paid.

Rizz Up will not use this provision to arbitrarily cancel a properly accepted transaction merely because the price later becomes less favourable to Rizz Up.

ORDERS

When you place an order through our website, you are submitting a request to purchase the selected products.

After an order is placed, you may receive an order confirmation or acknowledgement.

An order becomes accepted by Rizz Up when we expressly accept/process the order for fulfilment.

Rizz Up may decline or cancel an order in reasonable circumstances, including:

Product unavailability;
Incorrect pricing or technical errors;
Suspected fraud;
Payment problems;
Incorrect or incomplete customer information;
Courier/serviceability limitations;
Duplicate or unusual orders;
Abuse of promotional offers; or
Other legitimate operational or legal reasons.

Where payment has already been collected for an order that Rizz Up cancels, the applicable amount will be refunded in accordance with the applicable refund process.

ORDER CANCELLATION

Customers wishing to cancel an order should contact Rizz Up as soon as possible.

Cancellation may not be possible once an order has been packed, dispatched or transferred to a courier.

Any refund resulting from an eligible cancellation will be handled according to our Returns & Refunds Policy.

PAYMENT

Rizz Up may provide payment options including:

Online/prepaid payment; and
Cash on Delivery ("COD") for eligible orders and locations.

Online payments may be processed through Razorpay or other authorised payment/payment-processing providers.

Rizz Up does not request or require customers to provide their card PIN, CVV, banking password, UPI PIN or similar authentication credentials directly to Rizz Up.

Customers are responsible for ensuring that payment information supplied to the applicable payment provider is accurate and authorised.

CASH ON DELIVERY

COD availability is subject to product, order, PIN-code and courier eligibility.

A ₹100 additional COD charge applies to eligible COD orders.

Rizz Up may restrict COD availability where there is reasonable evidence of:

Repeated refusal of COD deliveries;
Repeated failed deliveries;
Incorrect addresses;
Fraudulent activity;
Abuse of COD;
Excessive cancellations; or
Other legitimate operational concerns.

Any such restriction will be applied subject to applicable law.

COUPONS AND PROMOTIONAL OFFERS

Rizz Up may offer promotional codes, discounts, free-shipping offers and other promotions.

Each promotion may have its own eligibility requirements and expiry date.

Unless specifically stated otherwise:

Promotional codes cannot be exchanged for cash;
A promotion may not be combined with another promotional code;
A promotion may have minimum order requirements;
A promotion may be limited to particular products/customers;
A promotional code obtained through fraud or misuse may be cancelled; and
Promotions may be changed or withdrawn before an order is placed.

Once a qualifying order has been successfully placed and accepted using a valid promotion, the applicable promotion will be applied according to its stated terms.

SHIPPING AND DELIVERY

Rizz Up currently ships within India, subject to courier serviceability.

Orders are generally handed over to the applicable logistics partner within 1–2 business days.

Estimated delivery is generally 5–10 business days after dispatch.

These are estimates and are not guaranteed delivery dates.

Delivery may be affected by courier operations, weather, public holidays, transportation disruptions, incorrect addresses and other circumstances beyond Rizz Up's reasonable control.

RETURNS, EXCHANGES AND REFUNDS

Returns and exchanges are governed by our separate Returns & Refunds Policy.

That policy covers matters including:

7-day return period;
Size exchanges;
Product condition;
Hangtag requirements;
Manufacturing defects;
Wrong products;
Damaged products;
Missing products;
Return shipping;
COD charges;
Refunds; and
Exchange limitations.

Nothing in these Terms is intended to remove consumer rights that cannot legally be excluded.

INTELLECTUAL PROPERTY

All intellectual property appearing on or associated with Rizz Up, including, where owned or lawfully used by Rizz Up:

Rizz Up name;
Rizz Up logo and branding;
Product artwork;
Character artwork;
Graphics;
Illustrations;
Product photographs;
Videos;
Website design;
Written content;
Product descriptions;
Marketing materials; and
Other original creative materials

is protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial purposes.

You must not, without prior written permission from Rizz Up:

Copy our artwork;
Reproduce our designs;
Sell or redistribute our designs;
Modify our creative assets for commercial use;
Use our branding to create confusion with Rizz Up;
Reproduce substantial portions of our website;
Use our photographs commercially; or
Represent Rizz Up's intellectual property as your own.

Nothing in these Terms transfers ownership of Rizz Up intellectual property to a customer.

CUSTOMER REVIEWS

Customers may be permitted to submit reviews, ratings, photographs and other content relating to products purchased from Rizz Up.

By submitting content, you confirm that:

The content is truthful to the best of your knowledge;
You have the right to submit it;
It does not infringe another person's intellectual-property, privacy or other rights;
It does not contain unlawful, abusive or fraudulent material; and
You are not submitting it in exchange for an undisclosed improper benefit.

Rizz Up may moderate, reject or remove content that is:

Fraudulent;
Spam;
Abusive;
Illegal;
Misleading;
Unrelated to the product;
Promotional for another business; or
Otherwise inappropriate.

USE OF CUSTOMER REVIEWS AND PHOTOGRAPHS

By submitting a review, photograph or other customer-generated content to Rizz Up, you grant Rizz Up a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, publish, adapt and distribute that content for legitimate business and marketing purposes.

This may include use on:

rizzup.store;
Product pages;
Social media;
Advertisements;
Marketing campaigns;
Promotional materials; and
Other Rizz Up-owned or controlled channels.

Rizz Up may use the customer's displayed name together with the submitted review.

Customers should not submit photographs containing another person unless they have the necessary permission to provide the photograph for this purpose.

Rizz Up does not claim ownership of a customer's original photograph merely because it has been submitted.

WEBSITE CONTENT AND AVAILABILITY

We aim to keep rizzup.store accurate, secure and available.

However, we do not guarantee that:

The website will always be available;
The website will always be error-free;
Every product will always be available;
Every website function will operate continuously; or
The website will be free from all technical interruptions.

Rizz Up may temporarily suspend, modify or restrict access to the website for:

Security;

Emergencies; or
Other legitimate operational reasons.

Rizz Up is not responsible for service interruptions, technical failures or delays caused solely by a third party and outside Rizz Up's reasonable control.

This does not limit any rights or remedies available to customers under applicable law.

ELECTRONIC COMMUNICATIONS

By using the website or placing an order, you agree that Rizz Up may communicate with you electronically regarding your:

Payments;
Account;
Shipping;
Delivery;

Exchanges;
Refunds;

This limitation does not exclude or limit liability where such exclusion or limitation is prohibited by applicable law, nor does it affect a customer's statutory consumer rights or remedies.

FORCE MAJEURE

Rizz Up will not be responsible for delay or failure to perform an obligation where the delay or failure is caused by circumstances beyond its reasonable control.

Such circumstances may include:

Natural disasters;
Severe weather;
Fire;
Flood;
Epidemics or public-health emergencies;
Government restrictions;
Strikes;
Civil disturbances;

GOVERNING LAW

These Terms are governed by the laws of India.

Nothing in these Terms is intended to prevent a consumer from exercising any statutory right available under applicable Indian consumer-protection law.

Subject to the foregoing, courts having appropriate jurisdiction in Chennai, Tamil Nadu shall have jurisdiction over matters arising in connection with these Terms, to the extent permitted by applicable law.

If Rizz Up does not immediately enforce a provision of these Terms, that does not mean Rizz Up has permanently waived its right to enforce that provision later.

These Terms, together with the applicable:

Privacy Policy;
Shipping Policy;
Returns & Refunds Policy; and
Other policies or terms expressly incorporated into the website,

form the terms governing your use of Rizz Up's website and purchase of its products, subject to applicable law.

CHANGES TO THESE TERMS

Rizz Up may update these Terms from time to time to reflect:

Changes to our products;
Changes to our services;
Changes to website functionality;
Changes to our business practices;
